Marcin Kurzatkowski obtained a summary judgment dismissal of the plaintiff's Labor Law 200 and 241(6) claims against a subcontractor at the construction site

On March 18, 2021, Marcin Kurzatkowski obtained a summary judgment dismissal of the plaintiff's Labor Law 200 and 241(6) claims against a subcontractor at the construction site. The plaintiff alleged that he tripped and fell over a copper pipe that was left behind on the floor. Mr. Kurzatkowski represented the subcontractor that was responsible for providing carting and cleaning services at the construction site.

Defending Nursing Homes

Representing nurses is different from representing doctors. Doctors implement orders and nurses follow them, so their mindset is different. Doctors are more likely to have their own insurance policies, and because some require the doctor''s consent to settle, medical malpractice cases are more likely to go to trial. Nurses on the other hand are less likely to be familiar with, and more apprehensive about, being the subject of litigation since they are but one employee among many on the same nursing home policy.

On May 12, 2015, a suspect who attacked an NYPD officer with a hammer was shot by police in the middle of the day, on a crowded Midtown Manhattan street. There were multiple eyewitnesses to the incident. Almost all of the witness reports were incorrect. Several people inaccurately reported that the police officers shot an unarmed man while he was on the ground and handcuffed. The incident was recorded on surveillance video, documenting the suspect attacking one of the officers with a hammer and that officer''s partner then shooting the man while he was in the midst of the attack.

Summary Judgment for Employer in Labor Law 241(6) Case

The Firm successfully obtained summary judgment dismissing all claims against our client, the plaintiff''s employer, on the date of plaintiff''s accident. Plaintiff alleged that he was seriously injured after tripping and falling at a construction site in the course of his employment. The owner, tenant, and general contractor sought contractual indemnity from our client. Through our written motion and subsequent oral argument, we convinced the court that the Firm''s client was not was not negligent in its performance of its work at the subject construction site and therefore, not obligated to contractually indemnify any party. The Firm''s client was the only party that was dismissed from the case; the case continues against several defendants and third-party defendants.

Unanimous Defense Verdict for Livery Driver

The Firm obtained a unanimous defense verdict on behalf of a local livery driver in a Kings County Supreme Court case involving a motorcycle crash in Brooklyn. The plaintiff alleged that the defendant caused him to crash his motorcycle and sustain serious, permanent injuries. Through our cross-examination of the plaintiff, the jury learned that plaintiff gave inconsistent accounts of how the accident occurred, had prior accidents and lawsuits, had been in trouble with law enforcement following prior accidents, and testified inconsistently while under oath on several occasions with regard to both the accident and his subsequent medical treatment.
